The work of the ATA Insurance Task Force (ITF) directly addresses this issue. The ITF was created to assist motor carriers to find affordable insurance and chose tort reform as a means of attacking the underlying cause of high insurance rates: outrageous and unfair verdicts caused by a deeply flawed judicial system. The ITF focuses its efforts on those reforms most important to the trucking industry (e.g., elimination of joint and several liability, caps on punitive damages, the recognition of collateral sources, the admissibility of non-use of seat belts) and works closely with state trucking associations to ensure that trucking industry interests are included in state tort reform efforts.
Significant successes have been achieved in many states where the ITF, through the state trucking association, has taken an active role. The ITF has become a major financial contributor to tort reform through state trucking associations and through national reform coalitions and groups, including the American Tort Reform Association and the Institute for Legal Reform. Recent political changes in state legislatures have made reform more difficult to achieve. In 2007 and 2008 the ITF effort has turned defensive against an onslaught of plaintiff-attorney attempts to role back previously won reforms.

ATA v. Ports of Los Angeles and Long BeachATA, with the support of its Intermodal Conference (IMCC), has been fighting efforts by the Ports of Los Angeles and Long Beach to reregulate the sector of the trucking industry that serves the ports. ATA Unveils Model Motor Carrier/ Broker AgreementsWith Department of Justice approval, ATA released a model agreements for structuring motor carrier and broker contractual relationships. On Aug. 10, 2006, the DOJ issued a business review letter that stated it had no present intention of challenging the ATA proposal to develop and publicize model carrier/broker agreements. Model Motor Carrier/Shipper AgreementAmerican Trucking Associations and the National Industrial Transportation League unveiled a Model Truckload Motor Carrier/Shipper Agreement for use by motor carriers and shippers in structuring their contractual relationships. |
